Description of Employee Racial/Ethnic Category, Citizen Status, Disability Status, and Veteran Status

The University of Minnesota is required to collect Racial/Ethnic Group Information to comply with Federal and State record keeping and reporting requirements pursuant to Executive Order 11246, Revised Order No. 4, Section 503 of the Rehabilitation Act of Amendments of 1974, Section 402 of the Vietnam Era Veterans Readjustment Assistance Act of 1974, Title VII of the Civil Rights Act of 1964 and Minnesota Statutes, Section 363.073.

Summary data, without names will be reported on the Integrated Post-Secondary Education Data System (IPEDS) report and the University of Minnesota's Affirmative Action Program. This information is private (as defined by the Minnesota Government Data Practices Act) and will not be released to the public. It will only be used in summary reporting format for compliance with Federal and State reporting requirements and implementation of University of Minnesota affirmative action policies.

Employees are requested, but not required, to provide information regarding their racial/ethnic group, veteran or disability status, and there are no consequences for failing to provide it. The University may acquire this information by visual survey. This may, however, result in the collection of erroneous information.

Employees are required to provide the other information. Failure to provide the required information (gender, social security number and citizenship status) could result in interruption of their paycheck or benefits, or their termination.

Racial/ethnic categories will be amended to reflect the Census 2000 categories as soon as clarification is received from the federal reporting agencies and PeopleSoft implements changes.

Racial/Ethnic Group (optional for employees to designate group, required for the University to designate group if employee does not)

The Equal Employment Opportunity Commission (EEOC) and the Integrated Post-Secondary Education Data System (IPEDS) define these.

  • White non-Hispanic: Persons having origins in any of the original peoples of Europe, North Africa or the Middle East (except those of Hispanic origin).

  • Black non-Hispanic: Persons having origins in any of the black racial groups of Africa (except those of Hispanic origin).

  • Asian or Pacific Islander: Persons having origins in any of the original peoples of the Far East, Southeast Asia, the Indian Subcontinent, or the Pacific Islands. This includes people from China, Japan, Korea, the Philippine Islands, American Samoa, India, and Vietnam. (This category, now split into two categories in PeopleSoft as Asian and Native Hawaiian/Other Pacific, will continue to be collected as one category until future guidance from the federal reporting agencies.)

  • American Indian or Alaskan Native: Persons having origins in any of the original peoples of North America or who maintain cultural identification through tribal affiliation or community recognition.

  • Hispanic: Persons of Mexican, Puerto Rican, Cuban, Central or South American, or other Spanish culture or origin, regardless of race.

  • Unknown Racial/Ethnic Category: This category is used ONLY if the employee did not select a racial/ethnic designation, AND the post secondary institution finds it impossible to place the employee in one of the aforementioned racial/ethnic categories. This may be updated or corrected in PeopleSoft.

Citizenship Status (required)

These categories are used by PeopleSoft and IPEDS:

  • Native: US citizen by birth or naturalization.

  • Naturalized: DO NOT USE. Select Native if the employee is a citizen.

  • Alien temporary (Nonresident alien): A person who is not a citizen or national of the United States and who is in this country on a visa or temporary basis and does not have the right to remain indefinitely. (These individuals are not counted by racial/ethnic category.)

  • Alien permanent (Resident alien): Resident aliens and other eligible (for financial aid purposes) non-citizens who are not citizens or nationals of the United States but who have been admitted as legal immigrants for the purpose of obtaining permanent resident alien status (and who hold either an alien registration card (Form I-551 or I-151), a Temporary Resident Card (Form I-688), or an Arrival-Departure Record (Form I-94) with a notation that conveys legal immigrant status such as Section 207 Refugee, Section 208 Asylee, Conditional Entrant Parolee or Cuban-Haitian) are to be reported in the appropriate racial/ethnic categories along with United States citizens.

  • Alien: DO NOT USE. Select "Alien-Permanent" or "Alien-Temporary." Employees misidentified as "Alien" are reported as "Alien Temporary."

  • Unknown Citizenship Status: DO NOT USE. Employees with missing or unknown citizenship status are reported as nonresident alien (NonRes). This should be updated or corrected in PeopleSoft.


Military status (optional for employees)

These are defined by defined by Section 402 of the Vietnam Era Veterans Readjustment Assistance Act of 1974, as amended.

  • Vietnam Era Veteran means any person who: (A) Served on active duty for a period of more than 180 days, and was discharged or released there from with other than a dishonorable discharge, if any part of such active duty occurred: (i) In the Republic of Vietnam between February 28, 1961, and May 7, 1975; or (ii) Between August 5, 1964, and May 7, 1975, in all cases: or (B) Was discharged or released from active duty for a service-connected disability if any part of such active duty was performed: (i) In the Republic of Vietnam between February 28, 1961, and May 7, 1975; or (ii) Between August 5, 1964, and May 7, 1975, in all cases.

  • Other Eligible Veteran: A veteran who served on active duty during a war or in a campaign or expedition for which a campaign badge has been authorized. This includes WWII veterans with active duty service between December 7, 1941 and April 28, 1952.

    The general category of Other Eligible Veterans includes two key veterans groups. First, it includes veterans who served in a "war". Since the last declaration of war issued by Congress initiated World War II, veterans with active duty service between December 7, 1941 and April 28, 1952 are considered veterans of World War II and are included in the Other Eligible Veterans category. The second veteran group in the Other Eligible Veterans category includes those veterans who served in a campaign or on an expedition for which a campaign badge, a service medal, or an expeditionary medal has been awarded.

    While the precise number of service members involved in each of these engagements is not available, it is clear that a relatively large number received the Korean Service Medal for the Korean conflict, but the number of veterans from this conflict who are still in the workforce is probably low. Similarly, it is clear that a relatively large number of service members received the SW Asia Service Medal for service during the Desert Shield or the Desert Storm against Iraq, and a much larger number of veterans from this conflict will still be in the workforce. For the remainder of these engagements, the number of veterans with qualifying service appears to be smaller and the probability of their participation in the current workforce is likely to be determined principally by the amount of time that has elapsed since the end of the engagement.

  • Newly separated veteran means any veteran who served on active duty in the U.S. Military, ground, naval or air service during the one-year period beginning on the date of such veteran's discharge or release from active duty.

    The reporting of "newly separated veterans" was optional for the Federal Contractor Veteran's Employment Vets-100 report in 2003. PeopleSoft does not currently provide record keeping and reporting for this category.

Disability status (optional for employees)

These are defined by Section 503 of the Rehabilitation Act of Amendments of 1974, as amended.

  • Disabled Veteran means: (A) A veteran who is entitled to compensation (or who but for the receipt of military retired pay would be entitled to compensation) under laws administered by the Department of Veterans Affairs for a disability: (i) Rated at 30 percent or more; or (ii) Rated at 10 to 20 percent in the case of a veteran who has been determined under 38 U.S.C. 3106 to have a serious employment handicap: or (B) A person who was discharged or released from active duty because of a service-connected disability.

  • Disabled Individual means any person who: (i) Has a physical or mental impairment which substantially limits one or more of such person's major life activities; (ii) Has a record of such an impairment; or (iii) Is regarded as having such an impairment. The completion of this part does not constitute notification for purposes of accommodation.
